I have received one additional proposal – from Diane Kennedy of IDEAlliance. IDEAlliance proposes to participate as a partner with OASIS in the development of the LegalXML specifications and will make Ms. Kennedy’s services available at 50% of their regular rate, but does not say what that rate is. Ms. Kennedy estimates that it will take ten days’ work to complete the assignment.

Like Betty Harvey, Diane Kennedy is very well versed in XML specifications development but has no previous work experience with the legal/law enforcement/courts world. I therefore rate her business qualifications below those of Vincent and Leff.

I have received the following questions/comments:

Question: Did Todd provide a cap on the number of hours or an estimate of the number of hours that would be required?

Answer: No.

Comment: I think the consultant should have to be a member of or join OASIS.

Response: That is a requirement in our RFP.

Comment: With regard to the outstanding issues of trademark infringement by XMLegal, I don't know how this could be handled if Todd were the successful candidate.

Response: Do we have outstanding issues of trademark infringement with Todd? Arising from his use of LegalXML with the terms inverted or from the use of our work products? Or does Todd claim that we have infringed his trademarks? I was not aware that we had any outstanding trademark issues and would be interested to know what they are.
