Tabulation of comments received on TGFv2 CSD following public review

I am happy with the recommended responses on all the comments. But I just want to chip in with a suggested way forward on Comment 38: the one which sees the Franchise Marketplace as Big Brother. My view is that this is simply a question of presentation not substance. The Franchise Marketplace is absolutely a non-Big Brother approach. It does not create some huge central repository of private data, but sets up a distributed, virtual operating model in which different organisations can collaborate to deliver more citizen-centric services in a way which a) is fully compliant with whatever the local data protection regulations require and b) embraces good practices in terms of giving citizens control, visibility, transparency and choice over use and sharing of their personal data. That said, I think the presentational issue is a real one, and should lead to changes in the TGF text for this pattern. The problem I think is twofold. First, the commenter is looking at this pattern in isolation, when it needs to be taken in conjunction with the rest of the TGF, and in particular: · The TGF Guiding Principle which says that “People should be given ownership and control of their personal data” · All the content of the Identity and Privacy Management pattern, which puts a premium on a consent-based approach to giving citizens’ control and visibility over their data. Second, I think he has reacted in particular against some specific words in the “Problem” description of the pattern, which talks about “global oversight of a customer’s needs”. This does indeed have slightly Orwellian tones, and clearly is potentially misleading even though the words were intended to describe context not the Franchise Marketplace model itself. So, against all that background, I attach my proposed amendments shown in revisions mode in the attached. These: · Remove the “global oversight” wording from the problem statement · Build in a new cross-reference in the Linkages section to the Identity and Privacy pattern · Add in a few places some appropriate mentions of “consent-based” and so on. Colin: do these changes also reflect the approach you had in mind? While making these revisions, I’ve also suggested some slight expansions of the text in a couple of other places in order to address comments 37, 42 and 43. John and Peter have suggested rejecting these comments. I’d be happy to go along with that if the TC prefers, but equally I think that the minor clarifications I’ve suggested might help address the lack of understanding shown in the comments. However I would be nervous about opening a can of worms by trying to slip in something at this stage. The whole question of re-balancing control feels like a huge area of controversy and one that would need a lot more research and evidence of change. Bear in mind that if we do make any changes then it has to go out to Public Review again on those changes so we could open a much wider debate. Maybe it's something for the next version after we've had time to give it proper consideration? Would you like to suggest what we might say now and where in the document please. Many of the issues around privacy and sharing/exchanging of identifiers come down to a question of control. The emergent thinking around giving back customers’ control of their data (Personal Data Ecosystems and the like), and having a ‘privacy and consent manager’ dashboard to manage those, offers the prospect of better information flow, and achievement of TGF objectives without compromising privacy principles. The TGF neither precludes, nor promotes this approach, and thereby leaves the reader with a sense that ‘the government is still in control’ of the process, albeit a transformed process. I think there is the opportunity to slip this in, and in so doing, better future-proofing the TGF for this more ‘macro economic’ trend of re-balancing the control between the State and the individual.
