Hi Mike,
1 and 2 are not the same.  In 2 you added a line break before <footnote>, 
and that linebreak is preserved as a single space in the output.  The line 
break after the <footnote> opening tag is ignored because the content model 
of footnote does not include #PCDATA.  The line break before <footnote> is 
#PCDATA in the para element, and it is preserved.
