I think it would be better to make it an error.

In cases like this, the intention of the author is probably a choice of
foo or bar. But treating it as implicit <choice> seems confusing because
all other patterns employ implicit <group>.

If the author really wants to have a group of foo and bar, then s/he may
be surprised to see a validator rejecting the schema. But s/he can
always use explicit <group>.
