Whats really confusing is the element constructors in both XSLT and XQuery treat children which are attribute nodes as children
e.g


<foo>{ attribute {"a"}{"b"} , "c" }</foo>

==>
<foo a="b">c</foo>

So obviously that means attributes are child nodes :)
