Criterion 1 is logical although for criterion 2 I wonder about the difference between a rule and an exception and will search to find and read John Cowan's analysis.
My thought comes from wondering if giving elements the same name to represent different data types would potentially be a bit complex for the user and technologies that use XML.
Is that akin to creating a database table or a programming class containing variables having the same name with different datatypes?
Is this really an exception or a part of the rule?

Rule: a xs:sequence contains any xs:elements.
Exception: if two xs:elements have the same name but different data types then they cannot both be in xs:sequence.
